North Dakota Farm and Business Regulations

ND Farm and Business Rules, Regulations and Guidelines

North Dakota Farm and Cottage Foods Manual
A manual developed by the Dakota College at Bottineau Entrepreneurial Center for Horticulture in conjunction with the North Dakota State Department of Health and local health units to assist you in determining your requirements, regulations that apply to you, and best practices as a vegetable or cottage food producer in North Dakota.

North Dakota Cottage Food Law
Above is a link to the actual current North Dakota Cottage Food Law as it is recorded in the ND Century Code.

The Food Safety Modernization Act
The Food Safety Modernization Act is a federal law that governs the sale and processing of many food items.  The Produce Safety Rule of this law in particular may apply to those that grow produce.  Below are resources that will assist you in determining if this law affects your farm.  If you have any questions, please be sure to contact Holly Mawby, Dakota College at Bottineau,  at 701-681-0252 or Jamie Good at the North Dakota Department of Agriculture at 701-328-2569 or jgood@nd.gov.  For a list of upcoming Produce Safety Trainings, please contact either Jamie or Holly.
FSMA Produce Safety Rule: How does it apply to my farm?
Although this video was produced for Minnesota, the rules and regulations are the same for North Dakota and other states.  The video does a good job of explaining if your farm and products will be affected or 'covered' under the Produce Safety Rule.
FSMA and PSR Overview - Montana Department of Agriculture
Like the video above, this video was produced by the Montana Department of Agriculture but the rules apply to North Dakota growers as well.  This video does a good job of explaining if your farm may need to meet the guidelines of FSMA and the PSR.

The Food Safety Modernization Act and Produce Safety Rule Resources
This page has a variety of fact sheets and worksheets to assist you with particular produce items, compliance with parts of the PSR, or implementing good agricultural practices.

Farm Food Safety Videos

The following are a series of videos from workshops delivered across North Dakota and covering topics of farm and cottage food regulations in the state and well as good food safety basics and best practices.  These videos were filmed with the assistance of local and regional health  unit employees as well as employees of the ND State Department of Health.  Thanks to the Dakota College at  Bottineau Entrepreneurial Center for Horticulture and funding from the USDA National Institute of Food and Agriculture Food Safety Outreach Program, project number 2017-70020-27238 USDA NIFA for making the workshops and videos possible.

Video SIX - Good Agricultural Practices and Basic Farm Food Safety Workshop  *note that this workshop contains information on basic farm food safety and Good Agricultural Practices.  While NOT regulations or laws for some farms who are exempt, they are the basis upon which laws and regulations are built.
